2. Estimates and Proposals
All estimates are based on the information available at the time and are valid for a limited period as stated in the proposal. Prices may change due to unforeseen site conditions, material availability, client-requested changes, or other factors beyond our control. Any changes to the scope of work may result in additional charges.

3. Scheduling and Delays
Service dates are scheduled based on availability, weather conditions, material delivery, and project readiness. Landscaping work is weather-dependent, and delays may occur due to rain, extreme temperatures, or other environmental conditions. Element Landscaping LLC is not responsible for delays caused by weather, suppliers, or circumstances beyond our reasonable control.

4. Client Responsibilities
Clients agree to:
• Provide accurate information regarding property boundaries, underground utilities, irrigation systems, and site conditions.
• Obtain any required permits, approvals, or permissions unless otherwise agreed in writing.
• Ensure access to the property during scheduled service times. Element Landscaping LLC is not responsible for damage resulting from undisclosed or improperly marked utilities, irrigation lines, or property features.

5. Payments and Billing
Payment terms will be outlined in your proposal or invoice. Unless otherwise stated:
• Deposits may be required before work begins.
• Final payment is due upon completion of services.
• Late payments may be subject to fees or interest as allowed by law.
We reserve the right to suspend or terminate services for non-payment.

6. Cancellations and Rescheduling
Clients may cancel or reschedule services by providing reasonable notice. Cancellations made after materials have been ordered or work has begun may result in charges for labor, materials, and restocking fees.

7. Plant and Material Disclaimer
Plants are living materials and their survival depends on proper care, weather conditions, soil quality, and other factors beyond our control. Unless otherwise stated in writing, Element Landscaping LLC does not guarantee the long-term survival of plants. Hardscape materials may vary in color, texture, and appearance.

8. Warranty and Workmanship
Element Landscaping LLC warrants that work will be performed in a professional manner consistent with industry standards. Any workmanship warranty, if offered, will be outlined in writing and is limited to the terms specified. This warranty does not cover damage caused by misuse, neglect, weather events, acts of nature, or third parties.

9. Limitation of Liability
To the fullest extent permitted by law, Element Landscaping LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our website or services. Our total liability shall not exceed the amount paid by the client for the specific services giving rise to the claim.
